The Legal Risks of Generative AI
Generative AI has moved from novelty to infrastructure in under three years. Most growing businesses now use it somewhere — drafting, coding, customer service, analysis — whether or not anyone signed it off. The technology is moving faster than the regulation designed to govern it, and that gap is where legal risk lives.
Where the exposure actually sits
Data protection. The most immediate risk is unintentional disclosure: employees pasting client information, personal data or commercially sensitive material into public AI tools. Once submitted, you may have limited control over how that data is stored or used. Under UK GDPR, that can amount to an unauthorised transfer or disclosure — with the usual consequences.
Intellectual property. Two questions matter. First, what went in: prompts containing your confidential information or third-party material you were licensed to use narrowly. Second, what came out: the ownership of AI-generated work is genuinely unsettled, and outputs may reproduce protected material. If AI-generated content ends up in your products, your contracts should say so — and say who bears the risk.
Contractual obligations. Many commercial agreements were drafted before generative AI existed. Confidentiality clauses, subcontracting restrictions and data processing terms may all be engaged when AI tools touch client work. The question is not whether you may use AI — it is whether your existing obligations already restrict how.
What sensible businesses are doing
Not banning the technology — that rarely works and usually just drives use underground. The pattern that works: an honest inventory of where AI is already used; a short, practical policy that distinguishes acceptable from unacceptable use; contract terms updated to address AI on both sides; and a designated owner for the question, so decisions get made rather than deferred.
Understanding the risks is the first step to managing them responsibly — and businesses that do this well are finding AI a source of advantage rather than exposure.
